1) Agreement to Terms

By accessing or using this website, placing an order, or downloading materials from it, you agree to be bound by these Terms and Conditions of Use and all applicable laws and regulations.

If you do not agree to these Terms, do not access or use the website.

You must be 21 years of age or older to access or purchase tobacco products from our site. It is unlawful to purchase tobacco products if you are under 21. We reserve the right to refuse access, hold an order, request additional verification, or cancel an order when age, identity, payment authorization, destination eligibility, or legal compliance cannot be confirmed.

2) Intellectual Property & Usage Restrictions

All content, concepts, materials, images, photographs, text, graphics, logos, trademarks, product names, videos, designs, and code on this site are owned by Cuban Heritage or its licensors and are protected by applicable copyright, trademark, and other intellectual-property laws.

Without our prior written permission, you may not:

Copy, reproduce, modify, use, republish, upload, post, transmit, or distribute site materials.
Copy, modify, or display any trademarks, business names, product names, or logos appearing on the site.
Redistribute any pages, text, images, or other content using framing or similar technology.
Use site materials for any commercial purpose or public display.
Attempt to decompile, reverse engineer, interfere with, or gain unauthorized access to software or systems used by the site.
Remove any copyright, trademark, or other proprietary notices.

3) No User-Generated Content

Our site does not currently host public comments, reviews, forums, or other user-generated content features.

Any information, photographs, documents, messages, or other materials sent directly to us through email, contact forms, age-verification processes, customer-support communications, or order-related communications will be handled as described in Section 7.

4) E-Commerce Terms — United States Only

Eligibility and Age Verification

You must be 21 years of age or older to place an order.

Orders are subject to age and identity verification during checkout and/or before fulfillment. We may use third-party verification services and may request additional documentation or information when reasonably necessary.

The person accepting a tobacco-product delivery must also be an adult 21 years of age or older.

We reserve the right to hold, refuse, or cancel any order that:

Fails age or identity verification.
Contains inaccurate or inconsistent customer information.
Appears fraudulent, unauthorized, or suspicious.
Cannot legally be sold or shipped to the requested destination.
Does not satisfy payment-processor, carrier, or compliance requirements.
Otherwise violates these Terms.

Order Acceptance

Submitting an order and receiving an automated order confirmation does not mean that the order has been finally accepted or shipped.

All orders remain subject to:

Payment approval.
Inventory availability.
Age and identity verification.
Address validation.
Fraud and compliance review.
Shipping availability.
Applicable federal, state, and local laws.

We may refuse, limit, hold, or cancel an order before shipment. If we cancel an order before shipment, any eligible amount already charged will be returned to the original payment method.

Prices, Availability and Errors

Prices, promotions, product availability, specifications, and other information may change without notice.

We make reasonable efforts to display accurate information, but the site may occasionally contain pricing errors, typographical errors, incorrect images, inaccurate product descriptions, inventory discrepancies, or other mistakes.

We reserve the right to correct errors, update information, refuse an order, or cancel an order affected by an error, even after an order confirmation has been issued. If an affected order has already been charged and is canceled, we will refund the eligible amount to the original payment method.

Payment

We accept the payment methods displayed at checkout.

By submitting payment information, you represent that:

You are authorized to use the selected payment method.
The information you provide is accurate and complete.
You authorize Cuban Heritage and its payment processors to charge the complete order total, including products, shipping, taxes, and other disclosed charges.

Payment information may be processed by third-party payment providers according to their own terms, privacy policies, and security procedures.

We may delay or cancel an order if payment authorization fails, is reversed, is disputed, or appears suspicious or unauthorized.

Shipping, Risk of Loss and Adult Signature

We ship eligible orders to eligible United States addresses through UPS. We do not currently ship internationally.

Shipping and delivery dates displayed at checkout, in order confirmations, or in UPS tracking are estimates and are not guarantees.

All tobacco-product shipments are sent using UPS Delivery Confirmation Adult Signature Required service. An adult who is at least 21 years of age must be available to accept and sign for the package. UPS may require acceptable government-issued identification or other evidence of age.

Leaving delivery instructions or requesting that a package be left unattended does not override the adult-signature requirement.

To the maximum extent permitted by applicable law, title and risk of loss pass to the customer when UPS accepts the shipment. However, eligible lost, damaged, missing, or incorrect-order claims will be handled in accordance with our Shipping Policy and Return & Refund Policy.

Additional shipping conditions, including processing times, delivery attempts, tracking, delays, address problems, returned shipments, and carrier claims, are explained in our Shipping Policy.

Restricted Destinations

We comply with applicable federal, state, and local requirements governing tobacco sales and shipments.

The availability of a destination or shipping rate at checkout does not guarantee that an order can be legally fulfilled.

Shipping may be restricted or unavailable based on the destination, product type, quantity, applicable law, tax requirements, carrier limitations, or other compliance considerations.

Availability to Alaska, Hawaii, U.S. territories, military addresses, P.O. boxes, freight-forwarding services, mail-forwarding services, reshipping companies, commercial mailbox services, or other special destinations may be limited or unavailable.

Orders that cannot legally or operationally be fulfilled will be refused or canceled.

Taxes

We collect applicable sales, excise, and other taxes when required.

Customers are responsible for any additional taxes, fees, or legally required charges not collected during checkout. We may cancel an order when applicable tax, licensing, reporting, or shipping obligations cannot be satisfied.

Returns and Refunds

Due to the nature of tobacco products, all sales are final, except for the specific situations described in our Return & Refund Policy.

Eligible issues may include:

An incorrect item being shipped.
Physical damage during transit.
Items missing from the shipment.
A package confirmed as lost or not delivered.

Eligible issues must be reported within 7 days of delivery. Customers must provide their order number, a description of the issue, and any requested photographs or video.

Returns require prior approval and a Return Merchandise Authorization (RMA). Products must not be returned without authorization.

Opened tobacco products and partial returns are not accepted. Original shipping charges are non-refundable except when required by law or expressly stated otherwise in our Return & Refund Policy.

Cancellations and Order Changes

You may request a cancellation or order change before the order enters fulfillment processing.

Once an order has been picked, packed, assigned a tracking number, or accepted by UPS, we cannot guarantee that it can be canceled, modified, redirected, or recalled.

A cancellation or change is not effective until Cuban Heritage confirms it.

Promotions and Discounted Orders

Promotions, discount codes, bundles, gifts, and free-shipping offers may be subject to additional conditions, expiration dates, eligible products, eligible destinations, and minimum purchase requirements.

Refunds on discounted orders are calculated using the amount actually paid after discounts. If a promotion includes a bundle or free item, we may require the complete bundle to be returned before approving an eligible refund.

5) Third-Party Services and Links

Our site may contain links to third-party websites or use third-party services, including social-media platforms, payment processors, shipping carriers, age-verification providers, analytics providers, advertising platforms, hosting services, and other technology providers.

Third-party links and services are provided for convenience and website operation. We do not control and are not responsible for their availability, content, security, policies, representations, errors, interruptions, or practices.

The use of third-party services may be subject to separate terms and privacy policies. Visiting or using third-party websites and services is at your own risk.

6) Product and Website Disclaimer

Site content is provided in good faith and is believed to be current and accurate. However, to the maximum extent permitted by law, the site and its content are provided on an “as is” and “as available” basis.

We make no warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

The website will always be available, uninterrupted, secure, or error-free.
Product information, availability, pricing, images, or descriptions will always be complete or free of errors.
Website defects or technical problems will always be corrected immediately.

To the maximum extent permitted by law, Cuban Heritage’s total liability arising from a particular order will not exceed the amount the customer actually paid to Cuban Heritage for that order.

11) Compliance Notice

Cuban Heritage seeks to operate in accordance with applicable federal, state, and local requirements governing the advertising, retail sale, taxation, payment, shipment, and delivery of tobacco products, including applicable Florida requirements.

We reserve the right to request additional information, restrict products or quantities, refuse service, hold an order, or cancel an order when reasonably necessary to comply with applicable law, carrier requirements, payment-processor requirements, licensing obligations, or these Terms.

We may update the website and these Terms from time to time.

The “Last updated” date reflects the latest revision. Updated Terms become effective when published unless a different effective date is stated.

Continued use of the website after an update means that you accept the revised Terms. The version in effect when an order is placed will generally apply to that order, except where a change is required by law or necessary to address fraud, security, or compliance concerns.

13) Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent permitted by law, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida for disputes arising from or relating to the website, an order, or these Terms.
